Terms and conditions

This quotation provides the recipient with services specifically delivered under the Principal Designer role in line with the Construction (Design and Management) Regulations 2015.

Archer Health and Safety Ltd have based this on the Principal Designer role being discharged from the date of formal appointment, when the client appoints Archer Health and Safety Ltd in writing as "a designer with control over the pre-construction phase as principal designer" under Regulation 5(1)(a) of the Construction (Design and Management) Regulations 2015 (CDM 2015).

The Principal Designer will cooperate with the project design team and other duty holders appointed or intending to be appointed, and expects their cooperation in return. Failure to do so could result in termination of services provided by Archer Health and Safety Ltd.

Domestic client

The client is a domestic client, as the work is carried out on their own home and not in connection with a business. Regulation 7 of CDM 2015 applies:

Scope of services

  1. Plan, manage and monitor the pre-construction phase and coordinate matters relating to health and safety, so that the project is carried out without risks to health and safety so far as is reasonably practicable (Regulation 11(1)).
  2. Identify and eliminate or control foreseeable risks, and ensure all designers comply with their duties under Regulation 9 (Regulation 11(3) and (4)).
  3. Ensure all persons working in relation to the pre-construction phase cooperate with the client, the principal designer and each other (Regulation 11(5)).
  4. Assist with the provision of pre-construction information and, where within our control, provide it promptly to every designer and contractor appointed or being considered for appointment (Regulation 11(6)).
  5. Liaise with the principal contractor for the duration of the appointment and share information relevant to the construction phase (Regulation 11(7)), and assist them in preparing the construction phase plan (Regulation 12(3)).
  6. Prepare, review, update and revise the health and safety file, and pass it to the client at the end of the project (Regulation 12(5), (6) and (10)).
  7. Two site visits are included.

Clarifications

  1. Principal Designer Role begins from the date of formal appointment.
  2. The client is a domestic client, so Regulation 5(3) does not apply (Regulation 7(3)). It is understood that the duties of a principal designer were held by the previously appointed principal designer or, by default, the designer in control of the pre-construction phase (Regulation 7(2)(a)), Niche Design Architects, until the appointment of Archer Health & Safety Ltd.
  3. Archer Health and Safety Ltd will discharge all remaining duties of a principal designer from the date of their appointment.
  4. Site visits associated with design change or meetings would be charged at a reduced day rate £450.00.
  5. Expenses incurred for additional travel to site or meeting locations will be charged at 55p per mile.
  6. Where construction has already started, this appointment replaces the previous principal designer from the date of appointment. Regulation 5(2) requires appointments to be made before the construction phase starts.
  7. This appointment is for the CDM 2015 Principal Designer role only. The Building Regulations Principal Designer role remains with David Bingham Architecture Ltd.
  8. Every duty holder must cooperate with Archer Health and Safety Ltd as far as is necessary for it to carry out its duties, and any information it is required to provide must be comprehensible and provided as soon as is practicable (Regulation 8(4) and (6)). As the Client is a domestic client, the Client's duties under Regulation 8(4) and (6) are carried out by Ebor Construction (Regulation 8(7)).
  9. Archer Health and Safety Ltd will request information in writing with a date for response. This includes information about residual design risks from designers (Regulation 9(3)(b)) and information for the health and safety file from the principal contractor (Regulation 12(7)).
  10. Where requested information is not provided by the date given, Archer Health and Safety Ltd will notify the Client and the duty holder concerned in writing and record the gap in the risk register and the health and safety file. Archer Health and Safety Ltd is not responsible for the consequences of information that is not provided, or for any delay it causes.
  11. Additional time spent chasing outstanding information, or reviewing information provided late, will be charged at the day rate in clarification 4, with prior notice to the Client. Where a lack of cooperation prevents Archer Health and Safety Ltd from carrying out its duties, it may suspend or end the appointment on written notice, and the health and safety file will be passed to the principal contractor (Regulation 12(8)).

Exclusions

  1. VAT which would be charged at the rate ruling at the time of invoice.
  2. The client duties under Regulations 4 and 6 of CDM 2015, unless agreed in writing under Regulation 7(1)(c).
  3. Architectural or engineering design, and surveys beyond review of those provided.
